Ethics case dismissed against client

Problem: A lawyer had a bar complaint filed against him alleging an improper fee in a complex case. The lawyer came to Rick because he trusted Rick to handle his case well.

Solution: Rick closely reviewed the documentary record and created a detailed chronology of the significant events in the representation. He consolidated the evidence into a supporting evidence binder showing all of the activities and the corresponding chronology. He then wrote a detailed memorandum, keyed to the evidence binder, showing how the facts established in the record did not support the ethics charges. After the bar’s Client Assistance Office referred the matter to disciplinary counsel for further investigation, Rick sought out the disciplinary counsel to answer questions and provide more facts from the record.

Result: This diligent work resulted in complete dismissal of the ethics charges.
